Wife is returning to work soon after the birth of son number 2.
She has be talking to her employer all the time about going back.
2 moths ago they decided when and what hours she will work.
She rang them this week to and was told that her hour and days have changed.
The wife told them all child care and class for son NO 1 and No2 have been sorted.
Wife was told "we all have to make sacrifices"
Talk to the union rep.
"thats how it is"
will she just have to get on with it?

Did she get anything in writing?

I dont know much about maternity laws but from what little I do understand, they have to leave the job open and offer part time/flexi hours on return. I imagine that if they have kept the job open then they have done their bit, as to the agreement on the hours, I dunno how she stands if she didnt get it in writing? Might be worth a trwal on t'internet... ACAS or something?

I don't think there is any legal comeback on just changing the days or exact hours worked.

If the hours being offered are crazy, like in the middle of the night, or there is something otherwise impractical about them, then there is a potential case of Constructive Dismissal and therefore compensation. If that route were pursued though, that scuppers the chances of a job with that company ever again, and possibly other companies in contact with it too.

They were going to send the paper work on, but changed their mind before they sent it.
She works for a very big health trust and have lot of females of with babies, i was thinking the could have been better about this

Seeing as it is a health trust, find the union rep and claim it is an attempt at gender based constructive dismissal, they are so busy being right on and PC they will probably back down

Might help.... not sure it says anything about agreement of hours. Perhaps she has a staff handbook? Often online, mine is.

Thanks, wife dont do "on line".
